본 연구의 목적은 해외 건설 시장의 규모는 커져가고 있으나, 국내 건설 기업은 국제 계약 관리는 경쟁력을 가지고 있지 않아 피해를 입는 사례가 증가함에 따라, 국제 계약은 국내 계약과 다른 특성을 가지고 있음을 인식하고, 해외 건설 공사에서 많이 사용되는 계약의 내용을 이해하고 대비하여 국내 건설업체 및 엔지니어링 업체의 해외 시장 경쟁력을 높이는데 도움이 되고자 한다. 본 연구에서는 국제적으로 인정을 받아 사용되고 있는 계약서인 FIDIC 개정신판의 내용을 살펴보고, Yellow Book과 Silver Book의 특징과 차이에 대한 견해를 바탕으로 하여 이해한다. 건설계약관리를 증진시키기 위한 개선방안으로 국내 계약조건의 국제표준화와 계약관리 분야의 전문 인력 양성을 제시해 본다. |

The purpose of this study was to help to raise competitiveness at domestic construction companies and engineering firms in overseas markets. The size of the overseas construction market grows bigger, but the domestic construction companies suffer damage increasingly because they don't have the competitive power of international construction contract management. In this situation, this study intends to recognize that international contract and domestic contract have different characteristic and understand condition of commonly using international construction contracts. In this study, consider revised new edition contents of the FIDIC that is an internationally recognized and now widely used as a contract system and understand characteristics and differences of the Yellow Book and the Silver Book. Finally, I propose a improvement for promoting construction contract management that is the international standardization of domestic terms and conditions and professional training of human resources in the field of contract management. |
